Terms of Service

Please read these Terms carefully before using Sparkmed. By accessing or using the service you agree to be bound by these Terms. If you do not agree to them, you must not use the service.
1. Who we are
Sparkmed is a trading name of Citrine & Sage Limited, a company registered in England and Wales (company number 16038867). In these Terms, "Sparkmed", "we", "us" and "our" refer to Citrine & Sage Limited. "You" and "your" refer to any person who accesses or uses the service, whether on a free or paid basis.
"Service" means our online platform for medical examination preparation, including question banks, AI-powered feedback and marking, mock examinations, SparkCoach, study analytics, flashcards and notes, together with the website at sparkmed.co.uk and any associated applications. "Sparkmed Content" means all questions, answers, explanations, notes, flashcards, mnemonics, AI-generated feedback and other educational materials made available through the Service.
2. Eligibility and accounts
- You must be at least 18 years of age, or the age of majority where you live, to create an account.
- You agree to provide accurate, current and complete registration details, including a valid email address, and to keep them up to date.
- You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us at medics@sparkmed.co.uk immediately if you suspect unauthorised use.
- Each account is for a single individual. Account sharing is prohibited. We monitor for shared access using methods such as concurrent-login detection, IP analysis and device fingerprinting, and we reserve the right to suspend accounts where sharing is detected.
3. Free access
We offer a free access tier so you can try Sparkmed before paying. This typically includes a set of free questions and an initial performance summary from SparkCoach. No payment details are required to use the free tier, and it does not convert into a paid subscription automatically. The features, question allowance and availability of the free tier may change from time to time.
4. Subscriptions, billing and payment
- Subscription plans vary by exam product, duration and price. The plans available, including pricing, are shown on the Service at the time of purchase. All prices are in British Pounds Sterling and include VAT where applicable.
- Subscriptions are fixed-term and do not renew automatically. Your access expires at the end of the subscription period unless you choose to purchase a further subscription. Your payment method is not charged again automatically.
- Payments are taken at the point of purchase via our payment processor, Stripe.
- We may offer promotional pricing, discount codes, referral incentives or other offers from time to time. Eligibility is at our discretion and may be subject to additional terms stated at the time of the offer.
5. Cancellation and refunds
Our refund terms, the statutory cooling-off period and the Sparkmed pass guarantee are set out in full on our Refunds and Pass Guarantee page, which forms part of these Terms. In summary:
- Because subscriptions are fixed-term, there is nothing to cancel to stop a future charge.
- You may request a refund within 7 days of purchase, provided you have not completed more than 50 questions.
- Your statutory rights as a consumer, including the 14-day right to cancel, are not affected by these Terms.
6. Use of the Service
During your subscription we grant you a limited, non-exclusive, non-transferable, revocable licence to access the Service and view Sparkmed Content for your personal, non-commercial educational use. You agree not to:
- reproduce, distribute, modify, publish, screenshot, photograph or otherwise capture and share Sparkmed Content, including questions, answers and explanations, by any means, including social media, messaging platforms, forums or file-sharing services;
- use automated means such as robots, scrapers or data-mining tools to access the Service or collect data from it;
- decompile, reverse engineer or disassemble any software forming part of the Service;
- circumvent, disable or interfere with any security or access-control features;
- upload or transmit any viruses, malware or other harmful code; or
- use the Service in any way that breaches any applicable law or the rights of others.
We may restrict or terminate your access if you breach these Terms or use the Service unlawfully or fraudulently.
7. AI-powered features
The Service includes AI-powered features such as automated marking, personalised feedback, study recommendations and SparkCoach. These are educational tools to support your learning. They are not a substitute for professional medical advice, clinical judgement or formal assessment by a qualified examiner.
While we take reasonable steps to ensure the accuracy and quality of AI-generated content, we do not warrant that it will be error-free, complete or suitable for any particular purpose, and you acknowledge that it may occasionally contain inaccuracies. Nothing in the Service constitutes medical advice or should be relied upon for clinical decision-making. You must always exercise your own professional judgement in clinical practice.
8. Intellectual property
All intellectual property rights in the Service and Sparkmed Content, including copyright, trade marks, database rights and design rights, are owned by or licensed to Citrine & Sage Limited and are protected by law. The Sparkmed name, logo and related branding are trade marks of Citrine & Sage Limited and may not be used without our prior written permission.
You retain ownership of any content you submit, such as your own notes. By submitting content you grant us a worldwide, royalty-free, non-exclusive licence to use it for the purpose of operating, improving and promoting the Service. If you believe content on the Service infringes your rights, contact medics@sparkmed.co.uk with full details.
9. Data protection
We collect and process your personal data in accordance with our Privacy Policy, which forms part of these Terms, and in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We do not sell your personal data and we do not show advertising. Payments are processed by Stripe, and we do not store your full card details on our servers.
10. Disclaimers and liability
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, and we do not warrant that the Service will be uninterrupted, secure or error-free, or that Sparkmed Content will be accurate or complete.
- The Service is a revision tool and is not a predictor of examination performance. Apart from the specific commitments in our pass guarantee, we make no guarantee that using it will result in you passing any examination.
- Sparkmed is independent and is not affiliated with, endorsed by or connected to any Royal College, the General Medical Council, NHS England or any other examining body. Sparkmed Content is independently developed.
- To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, data or goodwill. Our total liability to you for all claims arising from the Service will not exceed the amount you paid us in subscription fees in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
11. Content updates and service changes
The Sparkmed Content library is regularly updated to reflect changes in exam syllabi, guidelines and medical evidence. We may add, modify or remove content, features or any part of the Service at any time, and will use reasonable efforts to give advance notice of material changes that affect your use.
12. Acceptable use and conduct
You agree to use the Service lawfully and respectfully. We operate a zero-tolerance policy for abusive, aggressive or threatening behaviour towards Sparkmed staff, associates or other users, by any means, and reserve the right to suspend accounts where such behaviour occurs.
13. Suspension and termination
We may suspend or terminate your account if you breach these Terms, if we are required to do so by law, if we reasonably believe your account has been compromised, or if we detect fraudulent or abusive use. On termination your right to access the Service ends. Clauses intended to survive termination, including those on intellectual property, liability and governing law, will continue to apply.
14. Changes to these Terms
We may revise these Terms from time to time. We will notify you of material changes by email or through the Service before they take effect. Your continued use of the Service after the revised Terms take effect constitutes acceptance. The date of the most recent revision is shown at the top of this page.
15. Governing law
These Terms are governed by the laws of England and Wales, and you submit to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, nothing in this clause affects your statutory right to bring proceedings in the courts of the country where you live.
